INDIANAPOLIS (AP) – Former Subway pitchman Jared Fogle is appealing his more than 15-year prison sentence for having sex with underage prostitutes and possessing child pornography.
Fogle’s attorney, Ron Elberger, said Tuesday that he will appeal the sentence, but he declined to discuss it in detail. He filed a notice of appeal Monday in federal court in Indianapolis.
Fogle pleaded guilty last month to distributing and receiving child porn and traveling to engage in illicit sexual conduct with a child. As part of his plea deal, he agreed not to seek less than five years in prison term and prosecutors agreed not to seek more than 12{ years.
The judge gave Fogle more than 15 years, though, giving him grounds to appeal because it exceeded the maximum term prosecutors agreed to pursue.
