UMWA plan to appeal dismissal of lawsuit

CHARLESTON, W.Va. (AP) - A federal judge has dismissed a lawsuit seeking to preserve benefits for bankrupt Patriot Coal Corp.'s active and retired miners.

U.S. District Judge Joseph Goodwin on Friday sided with Peabody Energy and Arch Coal.

The United Mine Workers of America filed the lawsuit last year, saying the companies set up spinoff companies to rid themselves of their benefits obligations. The lawsuit argued they were still responsible for those benefits under the federal Employee Retirement and Income Securities Act.

But Goodwin ruled the law doesn't protect a pension fund's financial stability.

UMW President Cecil Roberts tells The Charleston Gazette the union plans to appeal.

Peabody spun off Patriot in 2007, and Patriot later acquired mines that Arch spun off into Magnum Coal. Patriot declared bankruptcy last year.

 

NHRA racing comes to Gateway this weekend

This NHRA Midwest Nationals kick off this weekend as part of a three-day drag racing event at Gateway Motorsports Park. Over 500 drivers and 50,000 spectators are expected to make it out to the track. The Midwest Nationals are the 21st of 24 events in the NHRA Mello Yello Drag Racing Series and the third of six races in the Countdown to the Championship playoffs. The total purse for the event this weekend is over $1 million dollars. See below for a full schedule of the events:

Police ID body found in abandoned building

St. Louis Police have identified the man found stabbed to death inside a vacant North St. Louis building.

40-year-old Kevin Davis was found with multiple stab wounds to the back inside a building in the 3700 block of Cote Brilliante. Anyone with information should contact the St. Louis City police.
